DEFINITIONS
For the purpose of these Conditions of Sale, the following definitions shall apply:
“The Purchaser” shall mean the party described as the customer.
“The Goods” shall mean all goods supplied by us to the Purchaser under this contract.
OVERRIDING PROVISIONS
All offers are accepted and all Goods are sold subject to and upon these Conditions of Sale. No addition, alteration variation or waiver of any term of these Conditions of Sale shall be binding unless agreed in writing by the parties. The Purchaser shall be deemed to have agreed these Conditions in relation all present and future dealings between the parties.
No Purchaser Terms and Conditions of Purchase and no other terms, conditions, warranties, particulars, standards, criteria, specifications and other matters, whether written or oral, express or implied, shall form part of or be deemed to be incorporated into this contract unless agreed in witting by a authorized officer of each party.
CREDIT ACCOUNT We may, in our absolute discretion, refuse any application for credit account or for an extension of an existing line of credit without disclosing there reason for so doing.
PRICES Goods will be charged at our prices ruling on the date of dispatch.
REFUNDS due to the nature of our product, refunds/cancellations will not normally be given. However if you have a complaint please customer@blkdiamond,co. Refunds will be given at the discretion of the management.
GENERAL NOTICES
By using our products you agree to the following and accept:
You are at least 18 years of age.
Your have consulted your dentist and they have assessed your teeth as being dentally fit for teeth whitening and given you their approval for whitening your teeth. Your teeth have had a professional clean from a hygienist.
If you are pregnant or breast-feeding you will not use our products without the approval and supervision of a dentist or other suitably qualified medical professional.
Employees, staff and agents of blkdiamond, llc are not dentists or in any other-way medical qualified to provided diagnosis or provide advice in relation to your particular circumstances and individual usage requirements.
You have no loose veneers, bridgework or loose crowns or if you do you understand that these will not whiten. Whitening products will not whiten crowns, veneers, bridges, fillings, or other dental work.
You have no loose or decayed teeth and are not suffering from gum disease (such as periodontal disease).
You should only use the whitening powder within the treatment times specified and like many other cosmetic procedures should NOT be overused. Also our teeth whitening products should not be used by habitual tobacco and alcohol users.
While using our teeth whitening products, and for at least an hour after each session, you must not smoke or drink red wine, tea, coffee, or any other food or drink containing food colouring. You should avoid these, and any other dark food or drink, during the entire whitening process, and for 48 hours after the end of treatment.
You are not allergic to any of the following ingredients;
- Organic Peppermint Oil
- Activated Coconut Shell Charcoal
- Calcium Bentonite Clay
- Organic Lemon Myrtle
If you have problems while you are using our products you should stop using them at once and seek a dentist to advice you. Your dentist should also have agreed to you whitening your teeth.
As a precaution, you should have someone else in the house when trying this for the first time.
GENERAL WHITENING DISCLAIMER
The results of teeth whitening are subjective and individual whitening results vary from person to person and blkdiamond, llc cannot guarantee a particular result. It is critical that you strictly follow the individual product instructions. Not following the instructions could, among other things, damage your teeth and gums. In some instances, even if you follow the instructions over brushing may result in blotchiness or a non-uniform tooth surface. The effect of teeth whitening fades over time and individual results again vary. Unexpected results may occur and may be irreversible. By buying a particular teeth whitening product, you accept all the risks associated with teeth whitening and release and hold blkdiamond, llc harmless and its agents, employees and principals harmless for any issues or complications arising from or connected with the teeth whitening.
Before purchasing any of these products if you suspect having any allergies to any of the teeth whitening products sold on blkdiamond.co or you are not sure if the product is suitable for you please consult your dentist before making any purchase. Sensitivity can be a part of the teeth whitening process and the degrees of sensitivity vary from person to person, We advise those who experience unusual sensitivity to stop using the product for a day or lowering the frequency of usage. If the sensitivity continues and causes severe discomfort we advise to stop using tooth whitening products immediately and consult your dentist.

INTERFERENCE WITH MARKINGS
The Purchaser shall not alter, obscure, remove, conceal or otherwise interfere with any marking or other indications of source of origin on any goods or their labeling and packaging.
Where the Goods supplied are supplied in any packaging or containers designed by the Purchaser or which are marked in accordance with the Purchasers specific request the Purchaser shall indemnify us in respect of any loss or liability incurred by us in consequence of any infringements of any patent, trademark, registered design or copyright arising from the supply of Goods in any such packaging or containers.
TITLE AND RISK
The risk in the Goods shall pass to the Purchaser upon delivery.
Title to the Goods shall remain our property until such time as all debts and other liability (whether arising under this contract or otherwise) owed by the Purchaser to us have been paid in full.
The Purchaser hereby irrevocably authorizes our representatives to enter upon the Purchasers premises where the Goods are stored, or are thought to be stored, for the purpose of repossessing them and subsequently reselling them.
DISCOUNTS
No retrospective/turnover discounts will be given to the Purchaser unless the charges for the period covered have been paid in accordance with standard settlement terms.
WAIVER OF CONDITIONS AND INDULGENCE
Any concessions granted by us to the PURCHASER or any waiver by us of its rights under these Conditions of Sale in respect of any particular transaction or series of transactions shall not be deemed an agreement to confer the same concession in respect of any further transaction.
FORCE MAJEURE
If our ability to perform its obligations hereunder is limited, delayed or prevented in whole or in apart by any reason whatsoever not reasonably within our control, we shall be excursed,, discharged and released without penalty from performance of the contract to the extent that such performance is so limited, delayed or prevented.
SUB CONTRACTS
We shall in our discretion be entitled to subcontract its obligations hereunder.

NOTICES
All notices and communications made pursuant to these Conditions of Sale by one party to the other shall be validly given or made by letter by first class registered post sent to the addresses listed overleaf or such address as shall be notified to the party concerned. All noted sent in accordance with the above shall be deemed to have been received within forty-eight hours of the date of posting.
ACCEPTANCE
By signature and/or acceptance of Goods, the Purchaser agrees to be bound by these Conditions of Sale.
